An agreement reached between the parties in a pending lawsuit that resolves the dispute to their mutual satisfaction and occurs without judicial intervention, supervision, or approval.

An out-of-court settlement provides that the parties relinquish their rights to pursue judicial remedies.

Where possible, clients are encouraged to resolve issues through negotiation. The emphasis on negotiation and out-of-court settlement can help avoid an environment in which bona fide differences of opinion become protracted legal battles, where antagonism and intransigence overcome reason and compromise, and where neither party truly wins.
